1. Agreement to Terms

By accessing or using Peyvo ("the Service"), you agree to be bound by these Terms of Service. If you disagree with any part of these terms, you may not access the Service.

2. Description of Service

Peyvo is a platform that allows users to upload files and make them available for purchase. Files are locked until payment is confirmed. The Service facilitates secure transactions between content creators and buyers.

3. User Accounts

To use certain features of the Service, you must register for an account. You agree to:

  • Provide accurate, current, and complete information
  • Maintain and update your information to keep it accurate
  • Maintain the security of your account credentials
  • Accept responsibility for all activities under your account
  • Notify us immediately of any unauthorized use

4. Acceptable Use

You agree not to:

  • Upload illegal, harmful, or offensive content
  • Violate any laws or regulations
  • Infringe on intellectual property rights
  • Upload viruses, malware, or malicious code
  • Attempt to gain unauthorized access to the Service
  • Interfere with or disrupt the Service
  • Use the Service for any fraudulent or illegal purpose
  • Impersonate any person or entity

5. Content and Intellectual Property

5.1 Your Content

You retain ownership of any content you upload. By uploading content, you grant us a license to store, display, and distribute your content as necessary to provide the Service.

5.2 Our Content

The Service, including its design, features, and functionality, is owned by us and protected by copyright, trademark, and other intellectual property laws.

6. Payments and Fees

6.1 Platform Fees

We charge a platform fee of 10% on each transaction. This fee is deducted before funds are transferred to your account.

6.2 Payment Processing

Payments are processed through Stripe. By using the Service, you agree to Stripe's terms of service. We are not responsible for payment processing errors or issues.

6.3 Refunds

Refunds are handled on a case-by-case basis. Buyers may file disputes within 72 hours of purchase. After the escrow period, refunds are at the creator's discretion.

7. Escrow System

Funds are held in escrow for 72 hours after payment to protect both buyers and sellers. During this period, buyers can file disputes if the content does not match the description. After 72 hours, if no dispute is filed, funds are automatically released to the seller.

8. Disputes

If you have a dispute with another user, you can file a dispute through the Service. We will review disputes on a case-by-case basis and make decisions in our sole discretion. Our decisions are final and binding.

We reserve the right to suspend or terminate accounts involved in disputes or fraudulent activity.

9. Prohibited Content

You may not upload, sell, or distribute content that:

  • Is illegal, harmful, or violates any laws
  • Infringes on intellectual property rights
  • Contains hate speech, harassment, or discrimination
  • Is pornographic, obscene, or sexually explicit
  • Contains personal information of others without consent
  • Is designed to harm or exploit minors

We reserve the right to remove any content that violates these terms without notice.

10. Termination

We may terminate or suspend your account immediately, without prior notice, for conduct that we believe violates these Terms or is harmful to other users, us, or third parties.

You may terminate your account at any time by contacting us. Upon termination, your right to use the Service will cease immediately.

11. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. WE DISCLAIM ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE.

12. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES.

13. Indemnification

You agree to indemnify and hold us harmless from any claims, damages, losses, liabilities, and expenses (including legal fees) arising out of or relating to your use of the Service, your content, or your violation of these Terms.

14. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify users of material changes by posting the updated Terms on this page and updating the "Last updated" date. Your continued use of the Service after such changes constitutes acceptance of the new Terms.

15. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which we operate, without regard to its conflict of law provisions.
